ARTICLE 2. PURPOSE OF THE WEBSITE

The purpose of the Website is the sale of custom-made 3D printing products by PREMIUM MINIATURES © to Customers.

 

ARTICLE 3. DEFINITIONS

"Customer" means any natural or legal person, whether governed by private or public law, registered on the Website.

"Quotation" means the specific terms applicable to Services, including in particular their price and execution conditions.

"The Entity" means J. A., acting as the publisher of the Website.

"User" means any natural or legal person, whether governed by private or public law, connecting to the Website.

"Service" means any service provided by PREMIUM MINIATURES ©, including but not limited to custom-made plastic or resin 3D printing.

"Product" means any item sold by PREMIUM MINIATURES © through the Website.

"Website" means the website accessible at www.premiumminiatures.com, as well as any related sub-sites, mirror sites, portals, and associated URL variations.

 

ARTICLE 4. SCOPE OF APPLICATION

Access to the Website is free of charge and available to all Users. Browsing the Website implies full acceptance of these General Terms and Conditions by any User. Simply connecting to the Website constitutes full and unconditional acceptance of these Terms and Conditions.

When registering on the Website, such acceptance shall be confirmed by checking the box corresponding to the following statement:

"I acknowledge that I have read and accepted the Terms of Service and Terms of Use."

By doing so, the User acknowledges having fully read and accepted these Terms without restriction.

Checking the aforementioned box shall have the same legal value as a handwritten signature. The User acknowledges the evidential value of the automatic recording systems used by www.premiumminiatures.com and, unless proven otherwise, waives the right to challenge them in the event of a dispute.

These General Terms and Conditions apply exclusively to the relationship between the parties, to the exclusion of any other terms, including those of the User.

Acceptance of these Terms and Conditions requires that Users possess the legal capacity to enter into agreements. Failing this, they must have authorization from a guardian or legal representative if legally incapacitated, from a parent or legal guardian if they are minors, or hold the necessary authority if acting on behalf of a legal entity.

 

ARTICLE 5. ORDER PROCESS

5.1. Product Orders

5.1.1. Placing an Order

To place an order, Users may select one or more Products and add them to their shopping cart. Product availability is indicated on the Website within the description page of each item. Once their selection is complete, Users may access their cart by clicking the designated button.

5.1.2. Order Validation by the User

By viewing their cart, Users may verify the quantity and nature of the selected Products, as well as their unit price and total price. They may remove one or more Products from their cart before final validation.

If satisfied with their order, Users may proceed to validate it. They will then be directed to a form allowing them either to log in using existing credentials or to create an account by completing the registration form with their personal information.

5.1.3. Payment by the Customer

Once logged in, or after completing the registration process, Customers will be invited to review or modify their billing and shipping details before proceeding with payment through a secure payment interface displaying the wording:

"Order with obligation to pay"

or any equivalent statement.

5.1.4. Order Confirmation by PREMIUM MINIATURES ©

Upon receipt of payment, PREMIUM MINIATURES © undertakes to acknowledge receipt electronically within a maximum period of twenty-four (24) hours.

Within the same timeframe, PREMIUM MINIATURES © shall send the Customer an email summarizing the order and confirming that it is being processed, including all relevant details.

5.2. Service Orders

Customers may order a Service directly by contacting PREMIUM MINIATURES © using the contact details specified in Article 1 of these Terms and Conditions.

PREMIUM MINIATURES © will then send a Quotation to the Customer by email, fax, or postal mail.

5.3. Manufacturing Time

Where an order includes items produced on demand (particularly custom 3D printed products), the Customer acknowledges that a manufacturing period of approximately seven (7) to ten (10) days may be required before shipment of the item.

 

ARTICLE 6. PRICES – PAYMENT

6.1. Prices

The prices applicable are those displayed on the Website on the date the order is placed. These prices may be modified at any time by PREMIUM MINIATURES ©. The prices displayed are valid only on the day of the order and shall not apply to future transactions.

All prices displayed on the Website are expressed in euros (€), inclusive of all applicable taxes, excluding shipping costs.

6.2. Payment Methods

Customers may pay for their orders using PayPal or by credit/debit card through Stripe.

For payments made by bank card, PREMIUM MINIATURES © has no access to any information relating to the Customer’s payment method. Payment is processed directly by the payment service provider and the financial institution concerned.

6.3. Invoicing

PREMIUM MINIATURES © shall issue or make available an electronic invoice to the Customer after each payment.

The Customer expressly agrees to receive invoices in electronic format.

6.4. Late Payment

Agreed payment dates may not be postponed for any reason whatsoever, including in the event of a dispute.

Any amount unpaid by the due date shall automatically and without prior notice incur late payment penalties calculated at a rate equal to three (3) times the legal interest rate, without prejudice to the immediate payment of the principal amount due.

In addition, any delay in payment shall result in:

  • a fixed recovery fee of forty euros (€40);

  • immediate payment of all outstanding amounts regardless of previously agreed payment terms;

  • an additional penalty equal to twenty percent (20%) of the outstanding amount;

  • the right for PREMIUM MINIATURES © to terminate the contract unilaterally at the Customer’s expense.

6.5. Retention of Title

All Products sold remain the exclusive property of PREMIUM MINIATURES © until full payment of the purchase price has been received, in accordance with this retention of title clause.

 

ARTICLE 7. COMPLAINTS – WITHDRAWAL – WARRANTY

7.1. Customer Service

Customer Service may be contacted Monday to Friday from 10:00 a.m. to 1:00 p.m. and from 2:00 p.m. to 6:00 p.m. by email at:

or by postal mail at the address specified in Article 1 of these General Terms and Conditions.

7.2. Right of Withdrawal – Distance Selling

7.2.1. Conditions for Exercising the Right of Withdrawal

In accordance with applicable distance-selling regulations, the Customer has a period of fourteen (14) calendar days to exercise the right of withdrawal without providing any reason and without incurring penalties, except for return shipping costs where applicable.

The withdrawal period begins:

  • on the date the contract is concluded for service contracts and digital content not supplied on a tangible medium;

  • on the date the Customer, or a third party designated by the Customer other than the carrier, receives the goods for sales contracts and service contracts involving the delivery of goods.

For orders involving multiple goods delivered separately, or goods consisting of multiple lots or parts delivered over a defined period, the withdrawal period begins upon receipt of the final item, lot, or part.

If the withdrawal period expires on a Saturday, Sunday, or public holiday, it shall be extended until the next business day.

The decision to withdraw must be communicated to PREMIUM MINIATURES © using a clear and unequivocal statement sent to the contact details specified in Article 1.

The Customer may use the model withdrawal form provided at the end of these Terms and Conditions.

PREMIUM MINIATURES © shall acknowledge receipt of the withdrawal request by email as soon as reasonably possible.

7.2.2. Effects of Withdrawal

The Customer must return the Products to PREMIUM MINIATURES ©, or to any person designated by it, without undue delay and no later than fourteen (14) days after notifying the decision to withdraw.

When the right of withdrawal is exercised, PREMIUM MINIATURES © shall reimburse all amounts paid by the Customer no later than fourteen (14) days after receiving notification of withdrawal.

However, reimbursement may be withheld until the Products have been received or until proof of shipment has been provided by the Customer, whichever occurs first.

Refunds shall be made using the same payment method used for the original transaction unless the Customer expressly agrees to another method.

The Customer shall bear the direct cost of returning the Product.

The Customer shall only be liable for any loss in value resulting from handling the Product beyond what is necessary to establish its nature, characteristics, and proper functioning.

7.2.3. Exclusions from the Right of Withdrawal

The right of withdrawal does not apply in particular to:

  • services fully performed before the end of the withdrawal period with the Customer’s prior express consent;

  • goods made according to the Customer’s specifications or clearly personalized;

  • goods liable to deteriorate or expire rapidly;

  • sealed goods unsealed after delivery that cannot be returned for health or hygiene reasons;

  • goods which, after delivery, are inseparably mixed with other items;

  • made-to-order products for which manufacturing has already begun before withdrawal is exercised;

  • digital content not supplied on a tangible medium when performance has begun with the Customer’s prior consent and waiver of the right of withdrawal.

The Customer expressly waives the right of withdrawal for Services that begin before the expiration of the fourteen-day withdrawal period by checking the following statement during order validation:

"I expressly waive my 14-day right of withdrawal for services provided before the end of this period."

The Customer shall receive confirmation of this waiver by email.

7.3. Contract Cancellation by the Customer

Consumer Customers may terminate the contract by registered mail with acknowledgment of receipt if delivery exceeds the agreed date by more than seven (7) days.

In such cases, all sums paid by the Customer shall be refunded.

This provision shall not apply in cases of force majeure.

7.4. Warranties

7.4.1. Warranty Against Apparent Defects

The Customer must inspect the Products upon delivery.

Any complaint relating to quantity, quality, references, or conformity with the order must be submitted within three (3) days following delivery.

No complaint shall be accepted after this period.

7.4.2. Warranty Against Hidden Defects

Customers benefit from all statutory warranties provided under applicable law, including:

  • the legal warranty of conformity;

  • the warranty against hidden defects;

  • product safety obligations imposed on sellers.

To invoke a warranty claim, the Customer must return the Product to PREMIUM MINIATURES © with a written explanation requesting either repair, replacement, or reimbursement.

Return shipping costs remain the responsibility of the Customer unless otherwise required by applicable consumer protection law.

 

ARTICLE 8. PERSONAL ACCOUNT

8.1. Creation of a Personal Account

Creating a personal account is a prerequisite for placing orders on the Website.

Users will be required to provide personal information necessary for account creation.

Failure to provide mandatory information will prevent account creation and order validation.

Users must choose a password when creating their account. This password guarantees the confidentiality of account information and must not be disclosed to third parties.

Customers undertake to regularly verify and update their personal information through their account.

8.2. Personal Account Content

The personal account enables Customers to view and track all orders placed through the Website.

PREMIUM MINIATURES © undertakes to securely store all contractual information whose retention is required by law.

8.2.2. Customer Contributions

Customers may publish comments regarding Products, Services, and their experience with PREMIUM MINIATURES ©.

Comments are subject to moderation and approval.

By submitting a comment, Customers grant PREMIUM MINIATURES © a free, non-exclusive, worldwide license to reproduce, publish, translate, adapt, and use such comments for commercial and promotional purposes for the entire duration of applicable intellectual property rights.

Customers warrant that they hold all necessary rights relating to their comments and agree to indemnify PREMIUM MINIATURES © against any claims arising from their publication.

8.3. Deletion of Personal Accounts

PREMIUM MINIATURES © reserves the right to delete any Customer account that violates these Terms and Conditions, provides inaccurate or fraudulent information, or remains inactive for at least one year.

Such deletion shall not entitle the Customer to any compensation.

 

ARTICLE 9. DELIVERY

9.1. Shipping Costs

Shipping or collection costs shall always be indicated to the Customer before payment.

The displayed shipping fees apply only to deliveries within mainland France, including Corsica.

For deliveries to any other destination, Customers must contact Customer Service.

All shipping costs displayed on the Website are expressed in euros (€), inclusive of all taxes.

9.2. Delivery Times

Orders are shipped Monday through Friday.

Products are delivered to the address provided during the ordering process.

Parcels are shipped, at the Customer’s choice:

  • via Colissimo Home Delivery or Pickup Point with tracking (5 to 7 business days);

  • via Mondial Relay Pickup Point with tracking (5 to 7 business days).

International shipments may be handled by UPS, DHL, Chronopost, or Colissimo depending on the destination.

A tracking number will be sent by email once the parcel has been dispatched.

PREMIUM MINIATURES © reserves the right to split shipments if one or more ordered Products become unavailable.

Shipping charges shall only be billed once.

Only dispatched Products shall be charged.

In the event of a shipping delay, the Customer will be notified by email and may cancel the order as long as it has not yet been dispatched.

9.3. Damaged Parcels

If a parcel is visibly damaged upon delivery, the Customer must refuse acceptance in order to benefit from the carrier's compensation procedures.

The Customer must also notify PREMIUM MINIATURES © without delay so that a replacement shipment may be arranged upon return of the damaged parcel.

In such circumstances, the standard delivery times specified above shall no longer apply.

ARTICLE 10. DATA PROTECTION AND PRIVACY

10.1. Data Protection Authority Registration – Data Controller

The personal data file maintained by PREMIUM MINIATURES © concerning Website Users has been declared to the competent data protection authority under registration number XXX.

10.2. Optional Nature of Data Provision

12.2. Force Majeure and Customer Fault

PREMIUM MINIATURES © shall not be held liable in cases of force majeure or Customer fault.

12.2.1. Force Majeure

Force majeure includes any event beyond the reasonable control of PREMIUM MINIATURES ©, including but not limited to:

  • fire;

  • epidemic or pandemic;

  • explosion;

  • earthquake;

  • telecommunications failures;

  • internet service provider failures;

  • transmission network failures;

  • infrastructure collapse;

  • unauthorized or fraudulent use of passwords or account credentials;

  • cyberattacks or hacking;

  • security breaches attributable to hosting providers or software developers;

  • flooding;

  • power outages;

  • war;

  • embargoes;

  • governmental actions, laws, regulations, requisitions or injunctions;

  • strikes;

  • boycotts;

  • and any other circumstance beyond reasonable control.

In such cases, PREMIUM MINIATURES © shall be relieved of its obligations for the duration and extent of the disruption.

12.2.2. Customer Fault

Customer fault includes, but is not limited to:

  • misuse of the Website, Products, or Services;

  • negligence or omission;

  • failure to follow instructions provided by PREMIUM MINIATURES ©;

  • unauthorized disclosure or misuse of passwords and account credentials;

  • submission of inaccurate information;

  • failure to update personal information;

  • use of automated systems, bots, crawlers, scripts, or automated requests contrary to these Terms and Conditions.

12.3. Technical Problems and Hyperlinks

PREMIUM MINIATURES © shall not be liable for temporary or prolonged unavailability of the Website due to technical issues.

Such unavailability shall not constitute grounds for compensation.

  • commercial losses.

In any event, the total liability of PREMIUM MINIATURES © shall not exceed the purchase price of the Product or Service concerned.

12.5. Hosting Provider Status

Any content published by Customers on the Website, including comments and reviews, remains the sole responsibility of the Customer.

In this respect, PREMIUM MINIATURES © acts solely as a hosting provider and cannot be held liable for such content unless, upon obtaining actual knowledge of unlawful content, it fails to remove it or disable access to it within a reasonable period.

All content available on the Website, including but not limited to:

  • graphics;

  • illustrations;

  • databases;

is the exclusive property of PREMIUM MINIATURES © or its licensors and is protected by copyright, trademark, database, and intellectual property laws.

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

The parties shall endeavor to replace the invalid provision with a valid provision reflecting the original intent as closely as possible.

14.5. No Waiver

Failure by PREMIUM MINIATURES © to enforce any provision of these Terms and Conditions shall not be construed as a waiver of its rights.

14.6. Language

These Terms and Conditions are drafted in French.

Any translation is provided for convenience only.

In the event of discrepancy, the French version shall prevail.

14.7. Unfair Terms

These Terms and Conditions shall apply subject to mandatory consumer protection laws and regulations concerning unfair contract terms.
